Appendix C - Additions and Updates
Appendix C is a list of all statutes that may be used on the Florida Uniform Traffic Citation (UTC). Per FLHSMV, any statute that is written on a UTC that is not in Appendix C will not be included on a driver's record.
If a statute is not in Appendix C, we cannot add it to TraCS for use on the UTC.
HSMV updates Appendix C once or twice per year, usually in July and/or October. When TraCS is notified that an updated version of Appendix C is available, we make the appropriate changes in our database and include those changes in our next scheduled release.
If you believe a statute is missing from or incorrect in Appendix C, you may email HSMV at courtassist@flhsmv.gov.
TraCS has already contacted them regarding the statutes listed below. Per HSMV, they will not be added to Appendix C. Their responses are noted below each statute. Further inquiries about these statutes should be directed to HSMV at courtassist@flhsmv.gov.
319.33(1)(d) - Alter/Forge Vehicle Identification Number (VIN)
- This is a criminal charge and not a traffic violation.
324.221(2) & 324.221(3) - Financial Responsibility - Insurance & Tag Not Assigned/Driving While License Suspended
- This is a penalty statute, not a charging statute. Officers may use 316.646 for insurance and 324.201(2) for Tag/DWLS
324.022 - Failure to have Motor Vehicle Liability Insurance
- This is not appropriate for inclusion in Appendix C. Officers can use 316.646.
320.26(1)(a) - Manufacture Possess Sale Dispose of Counterfeit Tags, Stickers, Registration
- This is a criminal charge and not a traffic violation.
316.1923 - Aggressive Careless Driving
- This is an administrative statute. Officers should use the Careless Driving statute and check the Aggressive box.
