Appendix C - Additions and Updates

Overview

Appendix C is a list of all statutes that may be used on the Florida Uniform Traffic Citation (UTC).   Per FLHSMV, any statute that is written on a UTC that is not in Appendix C will not be included on a driver's record.

The most recent version of Appendix C is here.

If a statute is not in Appendix C, we cannot add it to TraCS for use on the UTC.

We cannot add to or change the verbiage on the existing statutes unless directed to do so by FLHSMV.

HSMV updates Appendix C as additions or changes are needed.   When there is a new version of Appendix C, HSMV normally publishes it in July or October.

When TraCS is notified that a revised version of Appendix C is available, we update it in our database and include those changes in our next scheduled release.

Missing Statutes

If you believe a statute is missing from or incorrect in Appendix C, you may email HSMV at courtassist@flhsmv.gov to inquire.

HSMV has already been contacted regarding the missing statutes listed below.   Per HSMV, they will not be added to Appendix C.

316.1923 - Aggressive Careless Driving

This is an administrative statute.   Officers should use the Careless Driving statute and check the Aggressive box.

316.271(3) - Improper Use of Horn

This statute was removed from Appendix C in 2012 when the words, "but shall not otherwise use such horn when upon a highway" were eliminated.

319.33(1)(d) - Alter/Forge Vehicle Identification Number (VIN)

This is a criminal charge and not a traffic violation.

324.221(2) & 324.221(3) - Financial Responsibility - Insurance & Tag Not Assigned/Driving While License Suspended (DWLS)

This is a penalty statute, not a charging statute.   Officers may use 316.646 for insurance and 324.201(2) for Tag/DWLS

324.022 - Failure to have Motor Vehicle Liability Insurance

This is not appropriate for inclusion in Appendix C.   Officers may use 316.646.

320.26(1)(a) - Manufacture Possess Sale Dispose of Counterfeit Tags, Stickers, Registration

This is a criminal charge and not a traffic violation.
